Rules of the „Stay Dry Club”

I. General Rules:

• These Rules and Regulations, hereinafter referred to as the „Rules and Regulations”, set forth the rules of conduct and participation in the community service called „Stay Dry Club”, hereinafter referred to as the „Program”, aimed at customers who have purchased a Santi dry diving suit manufactured by Santi at any point/dealer offering Santi products. The Regulations set out the rules for joining the program, the rules of operation related to joining the related promotions and special offers, and the registration of customers personal data.
• The organizer of the Program is Santi Sp. z o.o., hereinafter referred to as „Organizer”, which administers the Program through a special information system called „System”.
• The Program is dedicated to customers who have purchased any dry suit from Santi’s oPer. They should be adults with full legal capacity, hereinafter referred to as „Participants”.
• Employees, owners and employees of stores and companies cooperating with Santi and their spouses, ascendants, descendants and siblings may participate in the program. The criterion for participation in the program is proof of ownership of the product mentioned above in the form of a warranty card, dry suit identification number and fiscal proof of purchase of the dry suit.
• The program is international in nature and runs from May 30, 2012 until cancellation, which date the Organizer shall announce to participants at least one month in advance through an informational announcement posted in stores, on the website www.staydryclub.com and www.santidiving.com.
• These terms and conditions and privacy policy are available at the Organizer’s office and on the website www.staydryclub.com. Registration of personal data at the same time signifies the participant’s acquaintance with these regulations and privacy policy.
• the Organizer’s mailing address for matters related to the program, hereinafter referred to as the „Organizer’s address” is: Santi Sp. z o.o., 7/9 T. Wendy St., 81-341 Gdynia

II. Program Conditions:

• To join the program, the participant must complete the registration form available on the specially constructed website dedicated to the program and have a product in the form of any model of dry diving suit, equipped with an individual identification number provided with the warranty when the product is purchased at any point of sale.
• By completing the form, the participant agrees to the rules of the regulations and undertakes to abide by them. The participant also agrees to the collection and processing of personal data in accordance with the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926, as amended) and to communicate with other entities by e-mail or other marketing action of the Organizer.
• Participation in the program is voluntary.
• Providing personal data to the extent specified in the regulations is necessary to participate in the program.
• Properly completed application form shall contain the following data: name, surname, address of residence or stay, telephone number, e-mail address, date of filling the form (i.e. date of entering the program), dry suit number, dry suit type, date of dry suit purchase and other data voluntarily provided by the participant.

3. They do not violate the rights of third parties,
4. He/she is familiar with the content of the Regulations and undertakes to comply with its provisions.

• Filling in the application form is done electronically through a dedicated website, which is also a dedicated portal for www.staydryclub.com.
• The date of registration of the application form by the participant and filling in all personal data in the system and confirmation of the authorization link sent electronically shall be considered the date of joining the program.
• All benefits of joining the program will be ePective upon entry into the program.
• In order to join the program, the participant is required to register the suit no later than 30 days from the first date of purchase of the suit.
• The condition for maintaining the extended warranty is a documented annual inspection of the drysuit at an authorized Santi service facility.
• The Participant has the right to inspect the contents of his/her personal data and to request its change, update or deletion by written request addressed to the Organizer at e-mail address: designer@santidiving.com. A request for deletion of personal data is at the same time a resignation from participation in the program.

• If the suit was purchased „second-hand” from a previous user who registered in the program after purchasing the suit, the new user/owner of the suit has the right to register the suit with new personal data. At the same time, one suit can have a maximum of two users who will be included in the program. The actual user who is a participant in the program should inform the Organizer about the disposal of the suit by e-mail or in person. On this basis, the Organizer has the right to remove him from the list of active program participants, and the new owner may register the suit in his name. Dry suits purchased in second circulation , from the secondary market are not subject to registration in the program.
• The program does not take into account the registration of suits purchased for marketing purposes , this includes demo suits.
• If a participant has more than one Santi suit, he/she will be able to register it in the primary profile created by him/her on the basis of adding the product in the personal data registration section after registering the first any suit.

III. Permanent benefits of joining the „Stay Dry Club”.

• Extended warranty up to 5 years from the original date of purchase.

• Local service discount on drysuit service up to 20%- according to the service price list.
• Once a year free inspection of the drysuit – leak test, possible repairs (leaks at the seams) and a report on the condition of the suit (the owner covers the cost of transportation to the service).

• Once a year, free rental of a wetsuit from Santi’s DEMO fleet for a period of 7 days.

IV. Final provisions:

• The Organizer is the administrator of the personal data collected and processed in connection with the participants’ participation in the program.
• The Organizer shall be entitled to make changes to these regulations during their validity. Any changes to the regulations will be ePective 7 days after the date of their introduction to the rulebook.
• If the regulations are amended, the organizer shall notify each Program Participant by making available the consolidated text of the amended regulations at authorized representatives and on the organizer’s website or by other means.
• The Organizer may exclude a Participant from the program with immediate ePect if he/she fails to comply with these regulations. In such case, the Participant will be notified by e-mail or registered mail.
• These regulations are constructed in accordance with Polish law.
• Any disputes arising from the implementation of obligations related to the program will be resolved by the court having jurisdiction over the seat of the Organizer.
• The regulations of the Action are available at staydryclub.pl
• In matters not regulated by these Regulations, the provisions of Polish law shall apply.
• Any disputes arising from the performance of obligations related to this program will be settled by the competent common court.
